Applies to: yastrelle.com (the “Site”), operated by Yastrelle LLC (“Yastrelle,” “we,” “us,” or “our”)

1. Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Site. We may update these Terms from time to time; continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Site Ownership and Operator

The Site is owned and operated by Yastrelle LLC, a limited liability company registered in the State of Ohio. All content, design, trademarks, and other intellectual property on the Site are owned by Yastrelle LLC or its licensors, except where otherwise noted.

3. Permitted and Prohibited Use

You may use the Site for lawful personal purposes, including browsing product information, joining the launch list, and, once enabled, creating an account and placing orders.

You may not:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Site, other accounts, or any connected systems.
  • Interfere with or disrupt the Site’s operation, security, or availability.
  • Scrape, harvest, or collect data from the Site through automated means without our express written permission.
  • Use the Site to transmit malicious code or engage in fraudulent activity.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

4. Intellectual Property and Trademarks

“Yastrelle,” the Yastrelle logo, and all related names, marks, and visual identity are trademarks of Yastrelle LLC. Product names, descriptions, images, and other Site content are protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent, except as necessary for ordinary personal, non-commercial use of the Site.

5. Product Information and Changes

We work to ensure product information—including descriptions, pricing, ingredients, shade ranges, availability, and images—is accurate. However, product names, categories, descriptions, availability, packaging, pricing, claims, ingredients, shade ranges, certifications, and fulfillment arrangements may change without notice. We do not warrant that product information on the Site is complete, current, or error-free, and we reserve the right to correct errors, inaccuracies, or omissions at any time.

6. Third-Party Services and Links

The Site may use or link to third-party services, including Shopify, our e-commerce platform and host, and Klaviyo, our email marketing and on-site tracking provider. Your use of those services may be subject to their own terms and privacy practices. We are not responsible for the content, accuracy, or practices of third-party services or linked sites.

7. User Accounts

If account creation is enabled on the Site:

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You must provide accurate and current information when creating and maintaining your account.
  • You must notify us promptly of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to the Site or other users.
  • You may request deletion of your account at any time by contacting legal@yastrelle.com, subject to any retention required for legal, tax, or accounting purposes.

8. Promotions and Discount Terms

Any promotions, discount codes, or similar offers made available on the Site are subject to their own specific terms, which will be disclosed at the time the promotion is offered. We reserve the right to modify, suspend, or terminate any promotion at any time, and to disqualify participation that we reasonably believe involves fraud, abuse, or violation of these Terms.

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

Product claims, where made, are based on available information at the time of publication and are not intended to diagnose, treat, cure, or prevent any condition. Individual results may vary.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YASTRELLE LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO YASTRELLE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Yastrelle LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

12. Governing Law, Arbitration, and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles.

Agreement to Arbitrate. You and Yastrelle LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products or services offered by Yastrelle will be resolved through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

Arbitration Procedure. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration will be conducted in Ohio, at another mutually agreed location, or by video or telephone conference where permitted by the applicable rules. The arbitrator’s decision will be final and binding, subject to any limited review permitted by the Federal Arbitration Act.

Class Action Waiver. You and Yastrelle LLC agree that any arbitration or claim will be conducted on an individual basis only, and not as a class, collective, or representative action. Neither party may serve as a class representative or participate as a member of a class of claimants in any proceeding arising out of or related to these Terms.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to legal@yastrelle.com within 30 days of first accepting these Terms. Your notice must include your name and a clear statement that you wish to opt out. Opting out of arbitration does not affect any other provision of these Terms.

Venue for Non-Arbitrable Matters. For any matter not subject to arbitration, including small claims court actions or claims for injunctive relief to protect intellectual property rights, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Ohio.

13. Termination

We reserve the right to suspend or terminate your access to the Site, including any account, at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is harmful to our business interests.

14. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Material changes will be reflected by an updated posting date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

15. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any applicable Shipping & Returns Policy, constitute the entire agreement between you and Yastrelle LLC regarding your use of the Site.
